Justin Baldoni and Blake Lively’s legal conundrum got an update recently after the former’s $400 million lawsuit was thrown out by the court, ruling that the statements at the center of it did not qualify for defamation. As far as Blake Lively’s lawyers are concerned, this is a huge win for Team Lively, but Megyn Kelly does not think so.
The journalist/political commentator posted a video to her YouTube channel, where she discussed how the lawsuit being thrown out doesn’t prove Blake Lively’s allegations against Justin Baldoni. Moreover, she pointed out that the actress is yet to face the worst thing in the trial – getting Amber Hearded.
What happened to Justin Baldoni’s lawsuit?

Before we get into why Megyn Kelly believes that Blake Lively is walking down the same path once trodden by Amber Heard, let’s quickly catch up with what happened with Justin Baldoni‘s $400 million lawsuit.
When Lively accused Baldoni of s*xual harassment, Baldoni not only denied all allegations, but also filed a countersuit against her, Ryan Reynolds, and publicist Leslie Sloane, $400 million. On top of that, he filed a $250 million lawsuit against the New York Times.
As per the lawsuit, Baldoni alleges defamation and extortion. Unfortunately for Team Baldoni, Judge Lewis J. Liman threw it out on June 09 and ruled that the statements that the lawsuit revolves around were either privileged or lacked the legal basis for defamation.
However, all is not lost for Baldoni yet, as his lawyers may amend the lawsuit and refile by June 23.
After this decision, Lively attended the Chanel Tribeca Festival Artists Dinner, where she looked extremely happy as she greeted fans and posed for the cameras. Kelly, in her video, pointed out the actress’ “great mood,” and called her out for “acting like she won the case.”
Take a look at a clip of Lively at the event:
It might be a small victory in Lively’s books, but the case is far from over. The question is, will she be victorious in the end or will Kelly’s predictions come true?
Is Blake Lively going to face the same fate as Amber Heard?

In the video titled, Blake Lively Is Celebrating the Dismissal of Justin Baldoni’s Lawsuit, But Is It Premature?, Kelly gives her honest opinion about what she thinks might go down if the two parties go to trial next year.
Kelly stated that going forward, Baldoni will be the defendant in the trial, while Lively will be the plaintiff. She also added that she has witnessed similar cases first-hand as a litigator, as well as actually seeing them through the trial.
In her words, it’s a “very simple formula” of how things will turn out. She claims that the case is now one of “He Said, She Said,” nature, and Lively will end up losing in court. Not only will she lose, but Kelly is convinced that the actress will get “Amber Hearded.”
If you remember, Heard and Johnny Depp were in a very public courtroom battle a couple of years ago, which ended with the latter winning and the former getting her reputation ruined, not only in the film industry, but outside it as well.
Kelly stated,
It’s a very simple case now. He said, she said, that’s what it is. No more cross claims…no more New York Times, no more press people. It’s her versus him. And on the merits of that case, I believe she will lose in the court of law. She’s going to get Amber Hearded.
The political commentator added that things are going to get “brutal” for Lively, who will be cross-examined by Baldoni’s lawyer, Bryan Freedman, which won’t be “pretty.”
If the two parties decide to go forward, the trial will begin sometime in March 2026 under Judge Liman. Only time will tell if Kelly’s predictions come true.
