More than one week after announcing that she had welcomed Elon Musk’s 13th baby, Ashley St. Clair filed paternity and custody petitions against the SpaceX CEO.

Ashley St. Clair is taking legal action against Elon Musk after announcing she welcomed their baby.

The conservative influencer, 26, has filed for sole custody of the son she says they share and also submitted a paternity petition to legally declare the SpaceX CEO as the father of her child, who would be his 13th, multiple outlets reported Feb. 22.

E! News has reached out to Musk’s rep for comment and has not heard back. Musk hasn’t made any public statements about welcoming a new child.

According to People, St. Clair alleges in her filings she and Musk began a “romantic relationship in or about May 2023” and conceived their son, identified by the initials R.S.C., in January 2024. Per the outlet, she further alleges that the Tesla CEO “acknowledged parentage of the child in various written correspondences,” including in a text message exchange after he was born in September.

St. Clair also alleges in her filings that she sent Musk a photo of her and the then-newborn shortly after his birth last fall and that he responded, “I look forward to seeing you and him this weekend,” People reported.

Musk was not present for R.S.C.’s birth, met him for the first time later that month and has since met him twice more, most recently in November, St. Clair alleges in her court filings, per the outlet. She also alleges that that month, the tech billionaire texted her, “I want to knock you up again.”

The 53-year-old “has had no involvement” in the care and upbringing of the son she says they share, People quoted the filings as saying. However, the two allegedly discussed safety concerns, with Musk allegedly saying, “If I make a mistake on security, [R.S.C.] will never know his father,” the outlet said.

The news comes a little more than one week after St. Clair announced she had welcomed a new baby—her second—and that Musk is the father, after which her spokesperson said they were “waiting for Elon to publicly acknowledge his parental role with Ashley.”

Musk, who has fathered 12 children with three other women, did not respond publicly to the influencer or her rep’s comments, which were made on his X platform. On Feb. 15, the day after St. Clair’s baby announcement, he responded to a post alleging that “Ashley St Clair plotted for HALF A DECADE to ensnare Elon Musk,” with one word: “Whoa.”

The same day, he responded on the social network to a photo Shivon Zilis posted of herself with their twins Azure and Strider, 2, commenting with a smiley face with hearts.

On Feb. 13, he had brought the three to the White House, along with his and ex Grimes‘ son X Æ A-Xii. Two days prior, the 4-year-old also joined his dad, one of President Donald Trump‘s top advisers, at a now-viral press conference with the U.S. leader in the Oval Office.
